Terms of Service
The short version. Mone$ter is a free app that scans your receipts and tells you when an item drops in price within the store's price-adjustment window. We don't process refunds — you claim them directly with the retailer. We're not affiliated with any of the retailers we track. Use the app for its intended purpose, don't try to break it, and we'll do our best to keep it running. If something goes wrong, our liability is limited because the app is free and we're a small team.
1. Your agreement with us
These Terms of Service ("Terms") form a binding agreement between you and Mone$ter ("we," "us," or "Mone$ter") covering your use of the Mone$ter mobile apps for iOS and Android and the website at monester.app (together, the "Service"). By creating an account, downloading the app, or using the Service in any way, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Service.
2. Who can use Mone$ter
You must be at least 13 years old to use Mone$ter. If you're between 13 and the age of legal majority where you live, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.
You also confirm that you are not located in a country subject to a Government of Canada embargo and that you are not on any list of restricted parties maintained by the Canadian or U.S. government.
3. What Mone$ter is (and isn't)
Mone$ter helps you spot opportunities to claim a price-adjustment refund from a retailer after you've already bought something. You scan a receipt, we read the line items, and we watch prices at supported retailers for the length of each retailer's price-adjustment window. When a price drops, we send you a notification so you can claim the difference directly with the retailer.
Mone$ter is not:
- A payment processor. We don't move money. Refunds are paid by the retailer to you, on whatever payment method you originally used.
- A guarantee. We can't promise we'll catch every price drop, that prices we show are accurate at every moment, or that a retailer will honour any particular refund claim.
- A retailer. We don't sell anything, and we're not affiliated with, endorsed by, or sponsored by any of the retailers we track. Retailer names and logos belong to their respective owners.
- Financial, legal, tax, or shopping advice. The information in the app is for your convenience; final decisions are yours.
4. Your account
You need to create an account to use most of the Service. You agree to give us accurate information when you sign up, to keep it accurate, and to keep your sign-in credentials secure. You're responsible for everything that happens under your account.
You can delete your account at any time from inside the app under Settings. Deletion follows the process described in our Privacy Policy, including a 30-day grace period during which you can cancel.
5. Acceptable use
When you use Mone$ter, you agree not to:
- Submit receipts that aren't yours, are fake, or have been altered.
- Use the Service to claim refunds you aren't actually entitled to, or to commit fraud against any retailer.
- Reverse-engineer, decompile, or attempt to extract the source code of the app, except to the extent applicable law expressly permits.
- Scrape, mirror, or systematically download data from the Service.
- Use any automated system, bot, or script to interact with the Service in a way that could degrade it for other users.
- Interfere with the Service's security, integrity, or availability, or with any other user's use of it.
- Use the Service to break any law, infringe anyone's rights, or harass, defame, or harm anyone.
- Resell, sublicense, or commercially exploit the Service or any part of it without our written permission.
6. Your receipts and data
The receipts and other information you put into Mone$ter stay yours. We only use them to provide the Service to you — to read line items, watch prices, send you alerts, and improve how the Service works for you.
To do that, you grant us a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, and display your receipts and account data through our service providers, solely for the purpose of operating and improving the Service. This license ends when you delete the content or your account, except for backups that roll off as described in the Privacy Policy.
7. Our app and content
The Mone$ter app, website, brand, design, logos, and underlying code are owned by Mone$ter or our licensors and are protected by Canadian and international copyright, trademark, and other laws. Subject to your compliance with these Terms, we grant you a personal, limited, non-transferable, non-exclusive, revocable licence to download and use the Service for your own non-commercial use.
We welcome feedback. If you send us suggestions, ideas, or feature requests, you grant us a perpetual, royalty-free licence to use them however we'd like, without any obligation to you.
8. Retailers and refunds
Each retailer sets its own price-adjustment policy, including the eligibility window, what items qualify, and how to claim. We do our best to track those policies, but they can change without notice. Whether a refund is honoured is entirely between you and the retailer.
The product names, store names, logos, and other brand assets shown in the app belong to the respective retailers and are used to identify items for your convenience. Their use does not imply any affiliation with, endorsement by, or sponsorship from any retailer.
9. Disclaimer of warranties
The Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, statutory, or otherwise. To the maximum extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising out of course of dealing or usage of trade.
We don't warrant that the Service will be uninterrupted, error-free, or secure; that price data is accurate or current at every moment; that refund claims will be successful; or that defects will be corrected. You use the Service at your own risk.
10. Limitation of liability
To the maximum extent permitted by law, in no event will Mone$ter or its officers, directors, employees, or agents be liable to you for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or related to your use of the Service — even if we have been advised of the possibility of such damages.
To the maximum extent permitted by law, our total cumulative liability arising out of or related to these Terms or the Service will not exceed the greater of (a) the amount you paid us in the twelve (12) months before the event giving rise to the claim, or (b) fifty Canadian dollars (CAD $50). Because the Service is free, (b) will usually apply.
Some jurisdictions don't allow the exclusion or limitation of certain warranties or liabilities, so some of the above may not apply to you. In that case, our liability is limited to the smallest extent permitted by applicable law.
11. Indemnification
You agree to indemnify and hold harmless Mone$ter and its officers, directors, employees, and agents from and against any claim, liability, damage, loss, or expense (including reasonable legal fees) arising out of or related to (a) your use of the Service in violation of these Terms, (b) your violation of any law or the rights of any third party, including any retailer, or (c) any refund claim you submit based on information from the Service.
12. Suspension and termination
You can stop using the Service at any time by deleting your account.
We may suspend or terminate your access to the Service, in whole or in part, with or without notice, if we reasonably believe you have violated these Terms, if continued provision of the Service to you would create legal or reputational risk for us, or if we discontinue the Service. Where reasonable and lawful, we will give you notice and an opportunity to address the issue first.
Sections of these Terms that by their nature should survive termination (including sections 6, 7, 9, 10, 11, 14, and 15) will survive.
13. Changes to these terms
We may update these Terms from time to time. When we do, we'll change the "Last updated" date at the top of this page. If the changes are material, we'll let you know in the app or by email before they take effect. If you continue to use the Service after a change takes effect, you accept the updated Terms. If you don't agree to the new Terms, please stop using the Service and delete your account.
14. Governing law and disputes
These Terms and any dispute arising out of or related to them or the Service are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict of laws rules.
You and Mone$ter agree to try in good faith to resolve any dispute informally before bringing a formal claim — please email us first at support@monester.app. If we can't resolve it informally, the courts located in the City of Waterloo, Ontario will have exclusive jurisdiction, except that either of us may seek injunctive or equitable relief in any court of competent jurisdiction. Nothing in these Terms limits any non-waivable statutory rights you may have under the consumer-protection laws of the jurisdiction where you live.
15. Other terms
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and Mone$ter about the Service and supersede any prior agreements.
- Severability. If any part of these Terms is found unenforceable, the rest will remain in full effect.
- No waiver. Our not enforcing a right under these Terms isn't a waiver of that right.
- Assignment. You can't assign or transfer these Terms without our written consent. We may assign them in connection with a merger, acquisition, financing, or sale of assets, on notice to you.
- Apple-specific. If you obtained the iOS app from the Apple App Store, you acknowledge that these Terms are between you and Mone$ter, not Apple, and that Apple is not responsible for the app or its content. Apple is a third-party beneficiary of these Terms entitled to enforce them against you.
- Google-specific. If you obtained the Android app from Google Play, you acknowledge that these Terms are between you and Mone$ter, not Google.
